This agreement contains the terms and conditions that apply to you when using our website. By ordering and purchasing through the facilities of Wristbandbuddy.com you agree you are subject to these Terms and Conditions. Our Terms and Conditions may change from time to time without prior notice, at our discretion. Use of this website reflects the latest agreement and supersedes all prior agreements, representations, warranties and understandings. It is your obligation to carefully review and acquaint yourself with our Terms and Conditions each time you visit our website as our Terms and Conditions contain important information that applies to your purchase(s) and are binding to both the customer and/or any and all the customer's authorized representatives.
ORDER POLICIES, PRICES, PAYMENTS & PROCESSING
Should any changes need to be make to your order, you must call our Sales Department within 24 hours of placing the order with the correction(s) to ensure modifications are made.
All prices listed on this website are U.S. currency.
All prices listed on this website are subject to confirmation.
Wristbandbuddy.com is not responsible for pricing, typographical, or other errors in an offer and reserves the right to cancel any order(s) arising from such errors.
All prices and minimum quantities are subject to change.
A price quote can only be validated in written form. Price quotes are only good for the date they are quoted unless otherwise stated.
Payment is due at the time of purchase.
Orders may be placed via the website’s shopping cart, via email with the assistance of a WristbandBuddy representative, or may be processed over the phone through our Customer Service department.
Payments are accepted via credit (Visa, MasterCard, American Express, Discover), check, cashier or certified check, or PayPal. If your order is placed using check, cashier or certified check and payment is not received within 30 days, your order will be cancelled. If your order is purchased via check payment production on your order will not begin until payment is received.
We offer Purchase Orders (P.O.s) to schools, non-profit organizations, and approved city and federal government organizations. All P.O. payment terms are Net 30 (days). P.O.s will be invoices immediately upon receipt of the order. Purchase orders not paid with Net 30 terms will be charged a late fee of 8% in addition to the original order amount. We reserve the right to refuse to place any orders.
Taxes will be charged for orders shipped to states in which Wristbandbuddy.com is obligated to collect and report such sales. Companies, individuals and organizations who are exempt from sales tax will be required to provide us with their resale certificate.
Production times typically vary 6 to 14 business days depending on the product(s), service, quantity of wristbands selected, and current production schedule. If you have a deadline/need-by date you are obligated to inform us via the Special Instructions box on the Start Designing page. You must include your need-by date before clicking "Add to Cart".
Production times are not guaranteed and are only meant to suggest an approximate time frame of when you can typically expect your order to be delivered from the date you place an order.
Wristbandbuddy.com will make every effort to ship your merchandise on or before your specified need-by date (if a date is specified during the time of your purchase and that date is within our given production time frame(s). Please be aware that we will not be held responsible for delays or lost merchandise on the part of the carrier who is delivering your merchandise. Wristbandbuddy.com is not liable for any delays, hold or charges due to customs when shipping to international customers.
WristbandBuddy reserves the right to choose the carrier that will be used to deliver an order. Currently, we use USPS, UPS, Fed Ex and DHL. Unless we receive notice via the Special Instructions box on the Start Designing page that an order must be delivered to you with 'Signature Confirmation' or 'Signature Required' we will ship as normal and carriers will leave your order in your mailbox, on your doorstep, etc.
To the best of our knowledge Fed Ex requires a signature for all delivered packages. Should you not be available at the time of delivery you should leave a signed notice (at the shipping address indicated on your order) instructing the deliverer to leave the package. If you do not leave a signed notice instructing the deliverer to leave your package Fed Ex will leave a notice letting you know when a second delivery attempt will be made or the notice will indicate where you can pick up your package.
WristbandBuddy currently offers free shipping to our customers in the United States or Canada - unless we are shipping directly from our manufaturer(s) overseas to meet a deadline/need-by date for a customer. In the instance that we must ship directly from our manufacturer(s) overseas the customer is responsible for the shipping charges.
If a package is returned to us for any reason and must be reshipped, WristbandBuddy is not responsible for the shipping costs - shipping costs are passed on to the customer and the customer must pay for the shipping costs before the order is reshipped.
International customers are responsible for shipping costs and/or duty fees in their country. Custom and/or duty fees are not included in our shipping charges. No gift or lower value will be written/marked on custom forms.
Cancellation of orders should be made within 24 hours of placing the order. Upon your request Wristbandbuddy.com will make effort to change or cancel your order if your request is received within 24 hours of placing your order. If the order has been paid for via credit card or debit card but the production process has not yet started a 5% cancellation fee will be applied. If the order has reached the pre-production set-up phase a 10% cancellation fee will be applied. If an order has begun production we cannot stop or modify the order. You will be charged the original amount for all orders cancelled once the production stage has begun.
Rush orders cannot be changed or cancelled one an order is submitted.
We reserve the right, without liability or prior notice, to revise, discontinue or cease to make available any or all products or to cancel any order at any time.
Refunds will not be issued due to customer error. This includes but is not limited to typos in the message, wrong PMS color of wristbands and/or message, wrong size ordered, choosing wrong production time (i.e., not selecting Rush Production if an order is needed before expected delivery date according to Standard Production time frame), choosing wrong shipping method if choosing your shipping method is available to you, etc. Wristbandbuddy.com is not liable for anything more than customizing your wristbands as ordered or available and shipping them to you.
If/once a refund is approved, refunds or credits will be processed within 5-10 business days of refund/credit being approved by Accounting department.
Production costs are non-refundable.
Once your order is placed, immediately send any necessary artwork to Sales@wristbandbuddy.com. Your email must include all instructions relating to your logo/artwork.
We inspect all submitted art to work to make certain it meets specific requirements in order to apply your design(s). We require all submitted artwork/logos in certain formats (i.e., vector format).
If you are in need of custom graphic images for your product(s), there is a $50.00 design fee per image.
We assume you have lawful rights and/or permissions to use any artwork, logos and/or graphic designs you provide to us and we are not liable for misuse of any such graphics.
We atrive to provide clear and color-correct images that reflect the true nature of our products; however, website images are innately limited in their ability to communicate, scale and detail so the color in your proof may not be the exact color you receive on your wristbands.
The colors offered for our products are displayed in pantone colors on the colors page listed under the Design tab.
When ordering Swirl wristbands please note that certain colors may bleed into other colors, essentially creating a new color on the bands (i.e., yellow + blue = green, red + yellow = orange, etc.). WristbandBuddy is not liable to issue refunds on customized silicone products due to "bleeding" as we cannot control this process which naturally occurs during the mixing of the silicone.
We do not provide digital proofs unless custom artwork is added to the product and/or the customer specifically asks for one in the Special Instructions box (on the Design Page) when placing an order or in an email sent PRIOR to placing an order, or if we are working with a customer to design a product that our Custom Builder (via the Design Page) cannot "build" automatically through the website. If these specific circumstances do not apply to your order you will not receive a digital proof when you place your order and your order will be sent directly to Production.
It is the customer's responsibility to follow up on the digital proof as soon as the order has been placed or PRIOR to the order being placed of the order is placed via email.
If a digital proof is not responded to within one (1) business day WristbandBuddy will assume that the customer does not require any changes or further approval for their order and will start production on the order as is. Furthermore, it is the customer's responsibility to call our customer care department in the event the digital proof has not been received by the customer to ensure proper communication regarding any changes and/or approval and placement of the order.
Although we cannot duplicate orders 100% we will try to replicate a re-order as close to the original as possible.
We cannot guarantee same color bands on re-orders.
PRIVACY POLICIES & CONFIDENTIALITY
We collect information from you when you place an order through our website, subscribe to our newsletter or fill out a form. Data we request that is not required is specified as optional.
When ordering through our site you will be asked to enter your name, email address, mailing address, phone number, shipping information and payment information.
Information we collect from you may be used to help improve our website and/or customer service experience, to process transactions and to send emails.
Supplied sensitive/credit information is transferred via Secure Socket Layer (SSL) and encrypted into our database. Your information is then accessed only by those authorized with special access rights to our systems, who are required to keep the information strictly confidential. Once a transaction is made private information regarding your credit cards, financials or tax ID numbers will not be stored on our website.
We do not sell, trade, distribute or commercially exploit your personally identifiable information to outside parties in any manner. Such customer information is confidential and will not be disclosed. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others' rights, property, or safety.
LIMITATIION OF LIABILITY
Wristbandbuddy.com shall not be liable beyond the remedies set forth herein.
Wristbandbuddy.com's maximum liability shall not exceed the total price paid for the products ordered by you.
In no event shall Wristbandbuddy.com be liable to you or to any third party for any claim by a third party or for any special, indirect, incidental, consequential or punitive damages, even if so advised of the possibility of such damages.
Wristbandbuddy.com shall not be liable for loss of product availability, loss or corruption of data or loss of profits or business. Some states do not allow limitations or the exclusion or limitation of incidental or consequential damages so such limitations may not apply to you.
Fraudulent activities are highly monitored within our site. If fraud is detected by you Wristbandbuddy.com shall resort all remedies available, and you shall be responsible for all costs and legal fees arising from such fraudulent activities.
You must not transmit any worms or viruses or any code of a destructive nature.
We make no representation that the operation of our site will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors. This site and its information, contents, materials, products and services are provided on an “as is” and “as available” basis. You and understand and agree that your use of this site is at your own risk.
We do not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free.
We make no express or implied warranties or representations with respect any products sold and offered in our website (including, without limitation, warranties of merchantability, non-infringement, or any implied warranties arising out of a course of performance, dealing, or trade usage).
